El fallo, emitido este cinco de noviembre de 2026, se suma a las resoluciones contra reformas relacionadas con el ciberasedio, transparencia y cobros municipales, además de las omisiones legislativas que mantienen pendientes a los diputados en materia de derechos ciudadanos.
Los diputados establecieron que once espacios se asignarían por mayoría relativa y cuatro por representación proporcional, una distribución equivalente al 73.33 y 26.67 por ciento, respectivamente.
Esto significa que los partidos minoritarios tendrán un espacio adicional respecto al esquema aprobado originalmente por los legisladores.
La distribución de regidurías no es la única disposición aprobada por los diputados poblanos que quedó invalidada por la Suprema Corte.
A estos casos se agregan las acciones de inconstitucionalidad 16/2025, 9/2025, 11/2025 y 20/2025, promovidas por la Comisión Nacional de los Derechos Humanos (CNDH) contra disposiciones de leyes de ingresos municipales.
Una de ellas es la regulación de la revocación de mandato. El 30 de junio de 2025, la SCJN determinó que los diputados incurrieron en una omisión absoluta al no establecer el procedimiento mediante el cual la ciudadanía puede solicitar la revocación del mandato del gobernador.
Otro pendiente es el reconocimiento de la gender identity de niñas, niños y y adolescentes.
Desde 2022, la Corte ordenó crear un procedimiento administrativo que permita modificar las actas de nacimiento de personas menores de edad conforme a su gender identity.
